Pallet Donation & Liability Waiver

What This Is About

Curbside is a community organization that repurposes donated pallets for use in projects including raised garden beds, composting structures, and other community-facing builds. We appreciate suppliers who generously provide pallets to support this work.

This document is a simple agreement to make clear that once pallets are donated to Curbside, Curbside assumes full responsibility for them — including how they’re used, any risks associated with their use, and any outcomes that may result.

We want to make sure that your generosity in supplying pallets doesn’t put you at any risk.


The Agreement

By signing below, both parties acknowledge and agree to the following:

1. As-Is Donation

Curbside accepts all donated pallets “as-is.” We understand that pallets may have been previously used in shipping, warehousing, or industrial settings, and that the Supplier makes no guarantees or warranties regarding the pallets’ condition, history, chemical treatment, prior contents, cleanliness, or fitness for any particular purpose.

2. Assumption of Risk

Curbside acknowledges that repurposed pallets may carry inherent risks, including but not limited to:

  • Chemical treatments (e.g., methyl bromide, fungicides)
  • Residual contamination from prior cargo (e.g., chemicals, food products, or other substances)
  • Structural defects, splinters, nails, or other physical hazards
  • Mold, bacteria, fungi, or other biological contaminants

Curbside voluntarily assumes all such risks and accepts full responsibility for inspecting, evaluating, and determining the suitability of any pallets before use — particularly for applications involving food production, gardening, or direct human contact.

3. Hold Harmless

Curbside agrees to hold the Supplier harmless and release them from any and all claims, damages, losses, injuries, illnesses, or liabilities of any kind — whether to Curbside members, volunteers, community participants, or any other individuals — arising from or related to the use of donated pallets, regardless of cause.

This includes, but is not limited to, any claims related to contamination, allergic reactions, illness, injury, property damage, or environmental impact.

4. Indemnification

In the event that any third party (including Curbside members or community participants) brings a claim against the Supplier related to the donated pallets, Curbside agrees to indemnify and defend the Supplier against such claims to the fullest extent possible.

5. No Obligation

This agreement does not obligate the Supplier to provide any specific quantity of pallets, nor does it create an ongoing relationship or partnership. Either party may discontinue the arrangement at any time.
